THE WEST BENGAL LEGISLATIVE COUNCIL (ABOLITION) ACT, 1969.
ACT NO. 20 OF 1969 [ 25th July, 1969.]
An Act to provide for the abolition of the Legislative Council of the State of West Bengal and for matters supplemental, incidental and consequential thereto.
BE it enacted by Parliament in the Twentieth Year of the Republic of India as follows:--
1. Short title and commencement.-
(1) This Act may be called the West Bengal Legislative Council (Abolition) Act, 1969 .
(2) It shall come into force on such date 1 as the Central Government may, by notification in the Official Gazette, appoint.
2. Definitions.- In this Act, unless the context otherwise requires,-
(a) " appropriate Government" means, as respects a law relating to a matter enumerated in List I in the Seventh Schedule to the Constitution, the Central Government, and as respects any other law, the State Government;
(b) " article" means an article of the Constitution;
(c) " Council" means the Legislative Council of the State of West Bengal;
(d) " law" includes any enactment, ordinance, regulation, order, bye- law, rule, scheme, notification or other instrument having the force of law in the whole or any part of the State of West Bengal;
(e) " Legislative Assembly" means the Legislative Assembly of the State of West Bengal.
3. Abolition of the Council.-
(1) The Legislative Council of the State of West Bengal is hereby abolished.
(2) On the abolition of the Council, every member thereof shall cease to be such member.
4. Amendment of article 168.- In sub- clause (a) of clause
(1) of article 168, for the words" Uttar Pradesh and West Bengal", the words" and Uttar Pradesh" shall be substituted. 1. 1st August, 1969 : vide Notifn. No. G. S. R. 1791, dated 28th July, 1969 , see Gazette of India, 1969 , Extraordinary, Pt. II, Sec. 3 (i), p. 549.
5. Amendment of Act 43 of 1950 .- In the Representation of the People Act, 1950 ,-
(a) in the Third Schedule, entry No. 9 relating to West Bengal shall be omitted;
(b) in the Fourth Schedule, the heading" West Bengal" and the entries thereunder shall be omitted.
6. Repeal of Delimitation of Council Constituencies (West Bengal) Order, 1951 .- The Delimitation of Council Constituencies (West Bengal) Order, 1951 , is hereby repealed.
7. Provision as to pending Bills.-
(1) A Bill pending in the Council immediately before the commencement of this Act which has not been passed by the Legislative Assembly shall lapse on the abolition of the Council.
(2) A Bill pending in the Council immediately before the commencement of this Act which has been passed by the Legislative Assembly shall not lapse on the abolition of the Council, but on such abolition shall be deemed to have been passed before such com encement by both Houses of the Legislature of the State of West Bengal in the form in which it was passed by the Legislative Assembly.
(3) If a Bill which having been passed by the Legislative Assembly is, before the commencement of this Act, either rejected by the Council or passed by the Council with amendments, the legislative Assembly may, after such commencement, pass the Bill aga n with or without such amendments, if any, as have been made by the Council and the Bill so passed shall be deemed to be a Bill introduced in and passed by the Legislative Assembly after the commencement of this Act.
8. Power to adapt laws.- The appropriate Government may, before the expiration of one year from the commencement of this Act, by order, make such adaptations and modifications of any law made before such commencement, whether by way of repeal or amendment as may be necessary or expedient in consequence of the abolition of the Council under section 3, and thereupon every such law shall have effect subject to the adaptations and modifications so made.
9. Power to construe laws.- Notwithstanding that no provision or insufficient provision has been made under section 8 for the adaptation or modification of a law made before the commencement of this Act, any court, tribunal or authority required or empowe ed to enforce such law may construe the law in such manner, without affecting the substance, as may be necessary or proper on account of the abolition of the Council, in regard to the matter before the court, tribunal or authority.

Mamata allots portfolios, keeps key ministries

Kolkata: West Bengal Chief Minister Mamata Banerjee on Friday allocated portfolios to her newly sworn-in council of ministers, keeping to herself nine departments, including Home, Land and Land Reforms.
Her other departments are Information and Cultural Affairs, Health and Family Welfare, Agriculture, Hill Affairs, Minority Affairs and Madrasa Education, Personnel and Administrative Reforms and Power.
Besides Banerjee, 35 ministers from Trinamool Congress and two from the Congress took oath on Friday. While both the Congress MLAs Manas Bhuniya and Abu Hena, hold Cabinet ranks, four TC legislators have been made Ministers of State.
Mamata allots portfolios, keeps key ministries
Economist and former FICCI general secretary Amit Mitra was allocated the departments of Finance and Excise, while Banerjee's close associate Partha Chatterjee was allocated Commerce and Industries, Public Enterprises, Industrial Reconstruction, Parliamentary Affairs and Information Technology.
Trinamool Congress state president Subrata Bakshi was allocated PWD and Transport, while former Chief Secretary Manish Gupta, who defeated former Chief Minister Buddhadeb Bhattacharjee in Jadavpur seat was given charge of the Development and Planning department.
Former Kolkata Mayor and Trinamool Congress vice-president Subrata Mukherjee was given charge of Public Health Engineering. Trinamool minority leader Abdul Karim Chowdhury was given charge of the Mass Education Extension and Library Services department.
Theatre personality and new Trinamool entrant Bratya Basu, who defeated CPI(M) heavyweight Goutam Deb in Dum Dum, was allocated the important portfolio of Higher Education, while former Joint Director of CBI Upendra Nath Biswas, one of Banerjee's non-politician 'trumpcards', was given Backward Classes Welfare department.
Retired Calcutta High Court Judge Noore Alam Chiowdhury who won from the Murarai seat on a Trinamool Congress ticket, was given Animal Resources Development.
Another Trinamool minority leader Javed Khan was given the Disaster Management, Fire and Emergency Services and Civil Defence. Banerjee's close aide Firhad Hakim got charge of the important Municipal Affairs and Urban Development department.
Party MLA from Singur Rabindranath Bhattacharjee was given the School Education department, while former Congress MLA Sabitri Mitra, who won from the Manikchak seat on a Trinamool ticket, got the Women and Child Development and Social Welfare department.
A former Naxalite leader Purnendu Basu, who joined the Trinamool Congress in the midst of the Singur movement, was given Labour.
West Bengal Pradesh Congress president Manas Bhuniya was allocated the departments of Irrigation and Waterways, Micro and Small Scale Enterprises and Textiles.
Congress Legislature Party leader Abu Hena was given the Fisheries, Food Processing Industries and Horticulture departments. Before finalising the portfolios, Banerjee held a meeting till late in the night with senior party leaders at the state secretariat.
Senior party leader Jyotipriya Mullick was allocated the Food and Civil Supplies department, Shanti Ram Mahato Self-Help Group and Self Employment and former IPS officer Hyder Aziz Safwi Cooperation and Inland Water Transport.

Kolkata: Left Front's decimation in West Bengal was complete on Friday with Chief Minister Buddhadeb Bhattacharjee losing the Jadavpur seat to Trinamool Congress candidate Manish Gupta, a former chief secretary.
Manish Gupta, who was chief secretary in 1998 during the tenure of Jyoti Basu and retired in 2001 serving one year under Bhattacharjee, defeated his former boss from the Left bastion of Jadavpur by 15,727 votes. Gupta polled 96,625 votes and Bhattacharjee 80,898.
All the five former Indian Police Service (IPS) officers fielded by the Trinamool Congress won comfortably. Former Additional Director of CBI Upen Biswas, who shot to the limelight for investigating the Bihar fodder scam and arresting RJD chief Lalu Prasad, won the Bagda seat in Nadia district defeating his nearest All India Forward Bloc opponent MK Sikdar by over 20,000 votes.
TMC's Manish Gupta defeats Buddhadeb
Another former IPS officer Rachhpal Singh, who as Inspector General (Presidency Range) had lodged an FIR against Mamata Banerjee when she was the Youth Congress president, for violence at a rally in 1994, won the Tarakeshwar seat in Hooghly district defeating CPI(M) candidate Pratim Chatterjee by over 25,000 votes.
Former additional director general of police and TC candidate from Bally seat in Howrah district Sultan Singh defeated his nearest CPI(M) rival Kanika Ganguly by over 5000 votes.
Former IPS officer HA Safwi won the Uluberia Purba seat in Howrah district. Safwi got 68,975 votes while his opponent Mohan Mondal secured 49,391. AM Joardar, another ex-IPS officer defeated his CPI(M) rival S Ghosh from the Krishnagar North by over 35,000 votes.
Besides the former IPS officers, Trinamool had fielded former Calcutta High Court Judge NA Chowdhury. He won from the Muraroi seat defeating his nearest CPI(M) rival Kamre Elahi by over 5000 votes.
The 34-year rule of the Left Front came of end on Friday with Mamata Banerjee leading the Trinamool Congress-Congress combine to a landslide win.
The communist regime had been able to win seven straight Assembly elections in the state but it failed to withstand the 'paribartan' of the Trinamool Congress.
